WHAT ARE MY RIGHTS UNDER FCRA?

The Fair Credit Reporting Act (FCRA) is the federal law that governs consumer background reports and consumer reporting agencies, like Candid Research, Inc. (CRAs). Under the FCRA, you have certain legal rights, including the right to access your background report and to correct any inaccuracies in your report. If an employer decides to run a background check on you through a CRA, the FCRA states that the employer must notify you that they intend to conduct a background check and that the results could influence their hiring decision and also obtain your written consent before conducting the background check. Before the employer can take adverse action against you based on negative information on your report, they must:

• Send you a Pre-Adverse Action Letter
• Give you a copy of the background report
• Provide the name, address, and phone number of the CRA that provided the report
• Give you a copy of “A Summary of Your Rights Under the FCRA”
• Allow a reasonable amount of time (generally five (5) days) for you to dispute the accuracy of report with the CRA; and allow time for the CRA to reinvestigate (up to 30 days)

If, after taking all these steps, the employer still decides not to hire you, they must send you a final Adverse Action Letter in writing.

HOW DO I RECEIVE A COPY OF MY BACKGROUND CHECK?

You may request a copy of your background report (if any) previously prepared by Candid Research, Inc. at no cost to you, by submitting your request via email, telephone, fax or USPS mail:

You can also Request a Consumer Copy of your report on our website.

Upon request, we will also provide you a list of all customers who may have received your background report during the past two (2) years.

HOW DO I DISPUTE THE ACCURACY OF MY REPORT?

At Candid Research, Inc. we are committed to accuracy. However, occasionally mistakes can happen due to transcription errors at the courthouse, similar name mismatches, identity theft, etc. We encourage you to review your background report for inaccuracies or missing information as soon as possible.

If you have reason to believe that any public record information furnished by our company is inaccurate or incomplete, you may File a Dispute and we will promptly investigate your concern.

HOW LONG WILL YOUR INVESTIGATION INTO MY DISPUTE TAKE?

While we strive to address your concern within 24 hours, the dispute investigation process may take up to 30 days to resolve, depending on the nature, scope and source of the information being disputed. If we determine that the information on the report is inaccurate, we will provide an amended report to you and the employer.

WHAT ARE MY RIGHTS AS A VICTIM OF HUMAN TRAFFICKING?

If you are a victim of human trafficking, you can File a Dispute or request to block the adverse information resulting from your trafficking experience. To make this request, please provide the following:

Proof of Identity:

• Full Name (Last Name, First Name, Middle Name)
• Aliases or other previously used names
• Address history for last 10 years
• Social Security Number
• Date of Birth
• Government-issued identification documents

Victim Determination Information:

• A determination from a federal, state, tribal governmental entity, court of competent jurisdiction, or a non-governmental organization or human trafficking task force, including victim service providers affiliated with these entities; or
• A self-attestation by a consumer who identifies as a victim of trafficking that is signed or certified by a federal, state, or tribal government entity, court of competent jurisdiction, or an authorized representative of these entities.

List of adverse items of information:

These are the adverse items of information that should not be reported by Candid Research, Inc. because the items resulted from human trafficking or sex trafficking. An “adverse item of information” could include records containing derogatory information, payment delinquencies or defaults, records of coerced debt, records of criminal arrests and convictions, and records of evictions or non-payment of rent.
